West Barnstable Fire District, Board of Water Commissioners – Meeting Agenda & Notice, Wednesday, March 27, 2013 at 7:00 PM

At the request of West Barnstable resident Ron Beaty, George Heufelder, Executive Director of the Barnstable County Department of Health and Environment, has graciously agreed to stop by with a staff member (during the “public comment” period) and provide concerned West Barnstable residents with appropriate information about the myriad of water quality testing services which are currently available from the County Lab. The WBFD Board of Water Commissioners Meeting will be held at 7:00 PM on Wednesday, March 27, 2013 at the West Barnstable Fire Station located on Route 149.

With no public water supply, West Barnstable area residents and businesses obtain their drinking water from private wells. Many of these wells possess various water purity issues such as excessive Iron content or increased acidity, among other things, which require water quality testing and possible remediation of one type or another…

Seven Barnstable County Government Boards Alleged to be Violating Open Meeting Law

WEST BARNSTABLE, MA – February 20, 2013 — West Barnstable resident and local public policy activist, Ron Beaty, announced today that the following seven (7) public bodies of the Barnstable County/Cape Cod Regional Government are in violation of the Massachusetts Open Meeting Law: the Cape Cod Commission, the Cape Cod Water Protection Collaborative-Steering Committee, the Barnstable County Commissioners, the Barnstable County Assembly of Delegates, the Barnstable County HOME Consortium-Advisory Council, the Barnstable County Assembly of Delegates-Standing Committee on Finance, and the Executive Committee-Cape & Vineyard Electric Cooperative, Inc.

Beaty stated that for this reason he has filed official Open Meeting Law Complaints with each of the named public entities. They each have fourteen (14) business days to respond.

Beaty elaborated that among other Open Meeting Law violations, each of the respective regional government entities are alleged to have failed to meet the necessary legal requirements pertaining to the posting of public meeting notices and agendas. The meeting agendas and notices of each of the listed County government committees, boards, commissions and/or bodies do not contain a recording of the date and time that the notice was posted on it (such as a time stamp) as required by the Open Meeting Law and its complementary regulations, 940 CMR 29.03 (1)(b) “The date and time that the notice is posted shall be conspicuously recorded thereon or therewith.”

Beaty explained that this legal failure includes the respective meeting agendas/notices posted online at the website of each respective County government body in question as well as upon the official Cape Cod Regional Government Bulletin Board located on the exterior of the Barnstable County Superior Courthouse.

Beaty claims that without such an official recording of date and time for a notice posting, it calls into question whether or not said meeting agendas and notices were actually posted 48 hours or more prior to a public meeting as required by law because there is no apparent evidentiary proof to substantiate it.

Beaty said that he filed the formal OML complaints, and will follow up with the Attorney General’s Office regarding them, in order to help maintain regional government transparency and accountability on the part of the various branches and entites of our Barnstable County government.

Cape Town & County Officials Discriminate on Committee Appointments

Local and regional public officials need to be consistently vigilant with regard to the unintentional practicing of indirect or “subtle discrimination” as opposed to overt discrimination regarding public policy decisions like the appointment of individuals to county and municipal committees, boards and/or commissions.

According to relevant research, one example of how to detect such “subtle discrimination practices” is to take note of exactly how many ethnic and/or racial minorities have been appointed to the various county and town multiple member bodies in the Cape Cod area.

If there presently exist sparse or no minority representation on these respective committees, then it is clear and decisive evidence of covert or subtle discriminatory practices on the part of those responsible for the committee appointments process. Those being discriminated against are being exposed to unequal opportunity, and thereby denied equal opportunity and access to county or municipal committee appointments.
